Welcome to the world of Les Parisiennes.

These Terms of Sale govern the purchase of all creations offered through the official website www.lesparisiennes.it.

The website is operated by V.S. di Sofiia Varzhanska, which designs, markets and sells its creations under the Les Parisiennes brand.

By placing an order through this website, the Client acknowledges that they have read, understood and accepted these Terms of Sale in their entirety.

For the purposes of these Terms of Sale, the Les Parisiennes brand identifies the Maison through which V.S. di Sofiia Varzhanska designs, presents and markets its creations.

Throughout these Terms, the terms “Les Parisiennes”, “the Maison”, “we”, “our” and “us” refer to V.S. di Sofiia Varzhanska, unless the context requires otherwise.

2. Scope of Application

These Terms of Sale apply to all purchases made through the official website www.lesparisiennes.it.

By placing an order, the Client represents and warrants that they are at least eighteen (18) years of age or otherwise possess the legal capacity to enter into binding contracts under the applicable law.

These Terms apply exclusively to purchases made through the official website of the Maison.

3. Our Creations

Every Les Parisiennes creation is handcrafted in Italy using carefully selected materials and traditional artisanal techniques that embody the excellence of Italian craftsmanship.

Due to the handcrafted nature of our creations and the use of natural materials, slight variations in colour, leather grain, texture, finish or other aesthetic characteristics may occur.

Such variations are an inherent feature of authentic artisanal craftsmanship and natural materials and shall not be considered manufacturing defects or lack of conformity.

The images displayed on the website are intended for illustrative purposes only. While every effort is made to accurately represent each creation, slight differences may occur due to lighting conditions, photography or the display settings of the Client’s device.

4. Availability of Creations

All creations displayed on the website are subject to availability.

Certain creations may be produced in limited quantities or exclusively on a made-to-order basis.

The presence of a creation on the website does not constitute a guarantee of its permanent availability.

Should a creation become unavailable after an order has been placed, the Maison will promptly inform the Client and offer either a full refund of any amount paid or, where available and accepted by the Client, an alternative solution.

5. Prices

All prices displayed on www.lesparisiennes.it are expressed in Euro (€) and include Value Added Tax (VAT) where applicable, unless otherwise specified.

Shipping costs, customs duties, import taxes and any other applicable charges are not included in the price of the creation unless expressly indicated during the checkout process.

The Maison reserves the right to modify the prices of its creations at any time and without prior notice. Such modifications shall not affect orders that have already been confirmed.

In the event that an obvious pricing error is published due to a typographical, technical or system malfunction, the Maison reserves the right to cancel the order, even after confirmation, provided that the Client is promptly informed and any amount already paid is fully refunded.

6. Orders

All orders placed through www.lesparisiennes.it are subject to acceptance by the Maison.

The submission of an order by the Client constitutes an offer to purchase the selected creations under these Terms of Sale.

The automatic acknowledgement of receipt of an order does not constitute acceptance by the Maison.

The contract of sale shall be deemed concluded only when the Maison sends the Client a separate confirmation that the order has been accepted.

The Maison reserves the right to refuse or cancel any order, including after its receipt, for legitimate reasons, including but not limited to:

  • unavailability of the requested creation;
  • inaccurate or incomplete information provided by the Client;
  • payment authorisation failure;
  • suspected fraudulent or unlawful activity;
  • events or circumstances beyond the reasonable control of the Maison preventing the fulfilment of the order.

Where an order is cancelled after payment has been received, the Client shall be entitled to a full refund of all amounts paid.

7. Payment

The Maison accepts the payment methods indicated on the website at the time of purchase.

Available payment methods may include, but are not limited to:

All payments are processed through secure payment service providers using encryption technologies that comply with the highest industry security standards.

The Maison does not store nor have access to the Client’s complete payment card details.

Orders shall only be processed after payment has been successfully authorised.

If payment is refused or cannot be completed for any reason, the order shall not be accepted.

8. Production and Delivery

Every Les Parisiennes creation is handcrafted in Italy.

Certain creations are produced exclusively on a made-to-order basis in order to ensure the highest standards of quality and artisanal craftsmanship.

The production and delivery times indicated on the website are provided for information purposes only and may vary depending on production requirements, material availability or circumstances beyond the reasonable control of the Maison.

The Maison shall make every reasonable effort to comply with the estimated delivery times but does not guarantee delivery on a specific date unless expressly agreed in writing.

Any delay resulting from force majeure, transportation disruptions, customs procedures or other events beyond the Maison’s reasonable control shall not constitute a breach of these Terms of Sale.

Should a significant delay occur, the Maison will promptly inform the Client and provide all available updates regarding the revised estimated delivery time.

9. Shipping

Les Parisiennes creations are shipped to the delivery address provided by the Client at the time the order is placed.

The Maison ships to the countries listed on the website at the time of purchase.

Shipping costs are calculated and communicated to the Client during the checkout process, before the order is finally confirmed.

Unless otherwise specified, all shipments are carried out through specialised couriers selected by the Maison to ensure the highest standards of reliability, security and traceability.

The risk of loss of or damage to the creation shall pass to the Client when the Client, or a third party designated by the Client other than the carrier, takes physical possession of the creation, unless otherwise provided by the applicable law.

Upon delivery, the Client is responsible for verifying that the number of packages, the condition of the packaging and the external condition of the shipment are in accordance with the order.

Should the Client notice any visible anomalies, including damaged, tampered with or visibly compromised packaging, the Client is encouraged to accept the delivery subject to reservation, specifying the observed anomalies on the carrier’s delivery receipt, and to promptly contact the Maison’s Customer Service.

The Maison shall not be held liable for delivery delays caused by the carrier, customs authorities, force majeure events or any other circumstances beyond the reasonable control of the Maison.

10. Customs Duties and Taxes

For shipments destined to countries outside the European Union, the Client may be required to pay customs duties, import taxes, local VAT, governmental charges or any other fees imposed by the laws of the destination country.

Such charges are not included in the price of the creations or in the shipping costs unless expressly stated during the checkout process, and shall be borne exclusively by the Client.

The Maison has no control over the amount of such duties, taxes or charges, which are determined solely by the competent authorities of the destination country.

The Client is encouraged to contact the customs authorities of the destination country prior to placing an order in order to verify the applicable customs duties, taxes, import restrictions or other legal requirements.

Should the Client refuse to accept the shipment due to the non-payment of customs duties, taxes or other import charges, the Maison reserves the right to deduct from any refund the shipping costs incurred, any return shipping costs and any additional expenses resulting from the refused shipment, without prejudice to any mandatory rights granted to the Client under applicable law.

11. Right of Withdrawal

Where the Client qualifies as a consumer under the applicable legislation, the Client shall have the right to withdraw from the purchase contract without providing any reason within fourteen (14) days from the day on which the Client, or a third party designated by the Client other than the carrier, acquires physical possession of the creation.

To exercise the right of withdrawal, the Client must communicate the decision by means of an unequivocal statement sent to the contact details provided by the Maison.

The Maison shall acknowledge receipt of the withdrawal request without undue delay.

The Client shall return the creation within fourteen (14) days from the date on which the withdrawal was communicated, using suitable packaging to preserve its integrity.

The returned creation must be:

  • unused;
  • free from any signs of wear, damage or alteration;
  • complete with its original packaging, any dust bags, accessories, labels and all other items supplied with the creation;
  • returned in the same condition in which it was delivered.

The Client shall be liable for any diminished value of the creation resulting from handling other than that necessary to establish the nature, characteristics and fit of the creation.

Any refund shall be processed within the time limits established by the applicable legislation and shall be made using the same method of payment originally used by the Client, unless otherwise agreed between the parties.

12. Returns and Exchanges

The Maison is committed to ensuring the highest level of satisfaction for every Client.

Without prejudice to the statutory right of withdrawal under the applicable legislation, returns and exchanges shall be accepted exclusively in accordance with the conditions set out in this Article.

To be eligible for a return or exchange, the creation must:

  • be returned within the time limits established by this policy;
  • be returned in the same condition in which it was delivered;
  • not have been worn, used or damaged;
  • be free from any signs of wear, stains, odours, alterations or any other condition affecting its resaleability;
  • be complete with its original packaging, any dust bags, labels, accessories and all other items supplied with the creation.

The Maison reserves the right to refuse any return or exchange if the returned creation does not comply with the conditions set out above.

Once the return has been accepted, the refund shall be processed using the same payment method originally used by the Client, unless otherwise agreed between the parties.

Any exchange is subject to the availability of the requested creation, size and, where applicable, colour variation at the time the exchange request is processed.

The costs associated with returns or exchanges shall be governed by the policy published on the official website of the Maison and by the applicable legislation.

Before authorising any refund or exchange, the Maison reserves the right to carefully inspect the condition of the returned creation.

13. Legal Warranty

The Maison guarantees that every Les Parisiennes creation complies with the quality standards required under the applicable legislation.

The Client is entitled to the statutory legal warranty of conformity provided for by the laws in force in the country where the purchase was made.

The warranty exclusively covers defects in conformity or manufacturing defects existing at the time the creation is delivered.

The warranty does not apply to damage resulting from:

  • normal wear and tear arising from regular use;
  • improper or negligent use of the creation;
  • accidents or accidental damage;
  • improper storage;
  • failure to follow the care instructions provided by the Maison;
  • repairs, modifications or alterations carried out by persons not authorised by the Maison;
  • the natural ageing of leather or any other materials used.

Any claim under the legal warranty must be submitted within the time limits established by the applicable legislation.

Where a lack of conformity is confirmed, the Maison shall, in accordance with the applicable legislation and at its sole discretion:

  • repair the creation;
  • replace the creation with an identical model, where available;
  • provide an equivalent creation; or
  • grant a full or partial refund, where provided by the applicable legislation.

Nothing in these Terms of Sale shall limit or exclude any mandatory rights granted to the Client under applicable law.

14. Care of the Creations

Every Les Parisiennes creation is handcrafted using carefully selected natural leather and premium materials.

To preserve the beauty, quality and original characteristics of each creation over time, Clients are encouraged to follow the care instructions provided by the Maison.

In particular, Clients are advised to:

  • avoid prolonged contact with water, humidity and direct heat sources;
  • protect the creation from oils, perfumes, solvents and abrasive substances;
  • store the creation in its original dust bag and box whenever it is not in use;
  • avoid prolonged exposure to direct sunlight;
  • use only products specifically designed for the care of fine leather.

Over time, natural leather may develop slight variations in colour, softness or texture.

These characteristics are a natural expression of authentic leather and form part of the individuality and authenticity of every creation.

Improper care or use contrary to the Maison’s recommendations may compromise the integrity of the creation and may invalidate the legal warranty to the extent permitted by the applicable legislation.

15. Intellectual Property

All intellectual property rights relating to the Les Parisiennes Maison, including, without limitation:

  • the name Les Parisiennes;
  • trademarks;
  • logos;
  • designs;
  • models;
  • creations;
  • photographs;
  • videos;
  • illustrations;
  • texts;
  • graphics;
  • the website design;
  • packaging;
  • catalogues;
  • digital content; and
  • any other material published on the website,

are the exclusive property of V.S. di Sofiia Varzhanska, the Les Parisiennes Maison, or of the respective rights holders who have authorised their use.

Any reproduction, distribution, modification, publication, transmission, sale, commercial exploitation or any other use, whether in whole or in part, of the content published on the website is strictly prohibited without the prior written consent of the relevant rights holder.

The purchase of a Les Parisiennes creation does not grant the Client any intellectual property rights in relation to the creation itself, the trademark, the design or any other distinctive element of the Maison.

The Maison reserves the right to take any legal action available under applicable law to protect its intellectual property rights against any unauthorised use.

16. Limitation of Liability

The Maison shall make every reasonable effort to ensure that the information published on the website is accurate, complete and regularly updated. However, the Maison does not warrant that the website will be free from material errors, inaccuracies or omissions.

To the fullest extent permitted by applicable law, the Maison shall not be liable for any direct, indirect, incidental or consequential damages arising from the use of the website, the inability to use it, or the purchase of its creations, except in cases of wilful misconduct or gross negligence.

Nothing in these Terms of Sale shall limit or exclude any mandatory rights granted to the Client under applicable law.

17. Privacy and Personal Data Protection

The Maison processes the Client’s personal data in full compliance with the applicable data protection legislation, including Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and any applicable national legislation.

18. Force Majeure

The Maison shall not be held liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including, but not limited to:

  • natural disasters;
  • fire;
  • floods;
  • war;
  • acts of terrorism;
  • epidemics or pandemics;
  • strikes;
  • transport disruptions;
  • failures of telecommunications or computer networks;
  • governmental actions or restrictions;
  • shortages of raw materials;
  • or any other event qualifying as force majeure under the applicable legislation.

In such circumstances, the Maison shall be entitled to suspend or extend the performance of its obligations for the duration of the force majeure event.

19. Governing Law and Jurisdiction

These Terms of Sale shall be governed by and construed in accordance with the laws of Italy.

Where the Client qualifies as a consumer under the applicable legislation, any mandatory rights granted by the laws of the Client’s country of habitual residence shall remain unaffected.

Any dispute relating to the interpretation, validity, performance or termination of these Terms of Sale shall be subject to the jurisdiction provided for under the applicable legislation.

Where the Client is not acting as a consumer, the Court of Busto Arsizio (Italy) shall have exclusive jurisdiction, unless otherwise required by mandatory law.

20. Amendments to the Terms of Sale

The Maison reserves the right to amend or update these Terms of Sale at any time.

Any amendments shall become effective from the date of their publication on www.lesparisiennes.it and shall apply exclusively to orders placed after that date.

The version of the Terms of Sale in force at the time the purchase contract is concluded shall continue to apply to the relevant order.

22. Authenticity of the Creations

Every Les Parisiennes creation is the result of a creative and artisanal process developed in Italy in accordance with the Maison’s standards of excellence.

The creations offered through the official website www.lesparisiennes.it and through any authorised retailers are the only creations recognised by the Maison as authentic.

The Maison does not guarantee the authenticity of creations purchased through unauthorised channels, unofficial retailers, third-party marketplaces or any person or entity not expressly authorised by the Maison.

Every Les Parisiennes creation is handcrafted using carefully selected materials and artisanal techniques that may result in unique characteristics for each individual creation.

Slight variations in leather grain, colour, finish or other aesthetic details are distinctive features of authentic craftsmanship and form part of the individuality of each creation. Such variations shall not be regarded as defects.

The Maison reserves the right to take any legal action necessary to protect its trademark, its creations, its intellectual property rights and its Clients against counterfeiting, imitation, unauthorised use of the trademark or the marketing of products falsely represented as authentic.

Purchasing through the Maison’s official channels guarantees the authenticity of the creation and entitles the Client to the Maison’s after-sales services and the warranties provided under these Terms of Sale.
